Emma Clark (nee Woolf) joined Fox as a Senior Associate in June 2009. She advises employers, employees, partners and firms on their full range of employment and partnership law concerns.
Emma trained at Allen & Overy LLP and qualified into the employment department in March 2002. Emma practised as an employment lawyer at Allen & Overy LLP for seven years until she joined Fox. She has enjoyed three client secondments acting as an in-house employment lawyer for three international FTSE 100 companies.
Emma provides pragmatic, jargon-free and individualised advice. She acts for clients across a range of sectors, sizes and jurisdictions, including many high-profile clients within the financial, legal, media and energy sectors.
She has wide-ranging experience of employment tribunal and high court proceedings including particular exposure to bonus claims, TUPE-related claims, whistle-blowing allegations, unfair dismissal and discrimination claims. She is a robust negotiator and regularly advises on senior executive appointments and terminations on behalf of both employers and employees. She has conducted numerous disciplinary and grievance procedures including navigating clients through FSA-related issues. She has particular expertise in large-scale redundancy exercises, advising clients on mitigating risk arising from TUPE transfers, maternity law and family-friendly rights. She was a regular advisor on the Maternity Alliance's telephone helpline for many years and has written and published a number of articles in legal journals and UK newspapers including recent articles relating to women in the city and Additional Paternity Leave & Pay.
Her recent matters include:
- Advising partners in a law firm on a team move and managing restrictive covenants;
- Assisting senior bankers in overturning gross misconduct allegations;
- Advising a management consultancy firm on maternity related issues;
- Drafting and negotiating favourable settlement agreements for senior executives;
- Advising a multinational financial services company on performance management issues and harmonising their employees' terms and conditions of employment.
Emma is an active member of the Employment Lawyers' Association (ELA) and is a member of ELA's Training Committee.
Outside the law, Emma enjoys travelling, hiking, going to the theatre and spending time with her family.
